Preliminary Information on the Contracting Process

This website www.capitten.com is owned by PUKMAL ITEMS, S.L., with Tax Identification Number (CIF) B66897935 and registered address at Vía Augusta, 17, Principal, 08006 Barcelona (Spain), operating commercially under the brand CAPITTEN.

These General Terms and Conditions of Contract govern the distance sales relationship between PUKMAL ITEMS, S.L. and the User or Client, in accordance with applicable legal provisions, in particular:

  • Law 7/1998 of 13 April on General Conditions of Contract,

  • Law 3/2014 of 27 March amending the revised text of the General Law for the Protection of Consumers and Users,

  • Organic Law 3/2018 of 5 December on Personal Data Protection and Guarantee of Digital Rights,

  • General Data Protection Regulation (EU) 2016/679 of the European Parliament and Council,

  • Law 7/1996 of 15 January on Retail Trade Regulation, and

  • Law 34/2002 of 11 July on Information Society Services and Electronic Commerce.

PUKMAL ITEMS, S.L. reserves the right to make modifications it deems appropriate, without prior notice, to these General Terms and Conditions. Such modifications may be made, through its websites, by any legally admissible means and shall be binding for as long as they remain published on the website, until they are validly replaced by subsequent modifications. However, PUKMAL ITEMS, S.L. reserves the right, when it considers appropriate, to apply Specific Terms and Conditions of Contract with preference over these General Terms and Conditions, announcing them in due form and time.

The purpose of this website is the sale of footwear and sportswear.

The duration of the contract shall be linked to the delivery of the product, without prejudice to the right of withdrawal.

You may also subscribe to the newsletter to receive offers of the products mentioned or general information that may be of interest.

As a User or Client, you expressly declare that you know, understand, and accept the terms of use and these General Terms and Conditions of Contract. Likewise, you declare that you are of legal age and have the legal capacity to access PUKMAL ITEMS, S.L. websites and to contract through them.

To purchase our products, you may go to the relevant section of our online store.

Upon completion of the purchase process, the Client will receive confirmation thereof by email. It is essential that during the purchase process the User provides a valid email address. If within 24 hours after placing the order you do not receive confirmation, please contact PUKMAL ITEMS, S.L. at hello@capitten.com.

All website content is available in Spanish and English.

Upon receiving the product at the delivery address provided, the Client will receive a copy of the order via email. If an invoice is required, it can be requested at hello@capitten.com.

Discount Codes, Gift Cards, and Other Promotions

To redeem a discount code, the Client must enter their code in the field “discount code or gift card” during the purchase process on the Website. Offer codes are case-sensitive and must be entered exactly as they appear. Only one offer code may be used per order.

Discount codes are not cumulative with other promotions or gifts, nor usable on already discounted items.

Products

The products described on the Website are exclusively for personal use. Clients may not sell or resell such products. We reserve the right, with or without notice, to cancel or reduce the quantity of products delivered to the Client if, at our sole discretion, such action would constitute a breach of these Terms and Conditions.

The products offered in our online store include a photograph and the essential characteristics of the item. This information comes from the manufacturer. The product color shown in the photograph is not binding, as it may vary depending on the screen quality of your device.

Warranties

PUKMAL ITEMS, S.L. is liable for any lack of conformity of all products offered on the Website for a period of three years from delivery. PUKMAL ITEMS, S.L. has an after-sales service during the stated period. The Client may contact the PUKMAL ITEMS, S.L. establishment, after-sales service, via email at hello@capitten.com, or at points established by the supplier. Prices

All products indicate the sales price in Euros and include Value Added Tax (VAT). If any other tax applies (IGIC or IPSI), this will be indicated.

Currency exchange commissions depend on the banking institution. Please consult your bank’s conditions. Shipping costs are added to the product price and indicated separately in the order form. The final price of the product will depend on the market to which the shipment is made.

Delivery and Shipping Costs

Shipping costs vary depending on the destination country. Please check shipping costs on the relevant page of the Website.

Payment Methods and Order Execution

The Client may pay for their order using any of the following methods. During the purchase process, you must indicate your choice:

  • Credit Card (VISA or MASTERCARD)
    All operations involving personal or banking data are carried out in a secure environment, a server based on SSL (Secure Sockets Layer) technology. All information you transmit travels encrypted across the network.

Credit card details are entered directly on the bank’s page (Bank POS Terminal) and are not entered or recorded on any PUKMAL ITEMS, S.L. server.

When paying with VISA or MASTERCARD, the following data will always be requested: card number, expiration date, and validation code (last three digits on the reverse side of the card). This provides greater transaction security.

If a fraudulent or improper charge is made using a payment card number, the cardholder may demand immediate cancellation of the charge. However, if the purchase was actually made by the cardholder and the refund request was unjustified, the Client shall be liable to PUKMAL ITEMS, S.L. for damages caused by such cancellation.

  • PayPal
    Allows secure and convenient online payments. PayPal’s network is based on existing financial infrastructure of bank accounts and credit cards, creating a global real-time payment solution.

Availability: Product availability depends on customer demand. Although PUKMAL ITEMS, S.L. periodically updates stock, the requested product may be sold out. In such a case, PUKMAL ITEMS, S.L. will notify the Client via email or WhatsApp within no more than 30 days. PUKMAL ITEMS, S.L. may offer:

  • delivery of a product with similar or superior features at no extra cost, or

  • reimbursement of the sums paid for the canceled order.

Right of Withdrawal, Returns, and Claims

Right of Withdrawal
The purchaser has a maximum period of 15 calendar days from receipt of the product to withdraw, without penalty and without giving reasons.

The right of withdrawal must be exercised by notification to hello@capitten.com or via the withdrawal form available on https://capitten.com/pages/returns.

According to Article 103 of Law 3/2014 of 27 March amending the General Law for the Protection of Consumers and Users, supplies of goods made to the consumer’s specifications, clearly personalized, or which by their nature cannot be returned or are liable to deteriorate or expire rapidly, are excluded from withdrawal.

Returns
The Client must return the product in perfect condition, in its original packaging, with labels, and all accessories, within 15 calendar days from exercising the right of withdrawal. The return period is met if the product is sent back before the end of the 15-day period.

The Client will bear the return shipping costs. If the product is not returned in perfect condition, the return will not be accepted, and the Client must arrange collection at their own expense. Clients will have 60 calendar days to collect the rejected item; otherwise, Capitten will consider the product abandoned and reserves the right to donate or destroy it depending on its condition.

Products will be inspected within 30 days to verify they are in perfect condition and the correct size/model. Returns will be accepted only if the items are unused and in perfect condition.

Defective Products
If a product is defective and the fault is not attributable to the Client, the Client has the right to return it at no cost. PUKMAL ITEMS, S.L. undertakes to cover return costs and replace the product with a new one under the agreed sales conditions.

If the Client wishes to file a claim, they may do so at:

Jurisdiction

PUKMAL ITEMS, S.L. reserves the right to bring civil or criminal actions as appropriate for improper use of the website and its contents, or for breach of these conditions.

The relationship between the User and the provider shall be governed by the applicable Spanish laws. In the event of a dispute, the parties may submit their conflicts to arbitration or to the ordinary jurisdiction, complying with jurisdiction and competence rules. PUKMAL ITEMS, S.L. has its registered address in Barcelona, Spain.

Personal Data Protection

During the purchase process, certain personal data will be requested. All fields marked with an asterisk (*) are mandatory.

Capitten guarantees full compliance with the obligations established by Organic Law 15/1999 of 13 December on the Protection of Personal Data, as well as Royal Decree 1720/2007 of 21 December and other applicable regulations. Capitten shall adopt the necessary technical measures to avoid alteration, loss, or unauthorized processing of personal data, bearing in mind the limitations of the Internet, acknowledging that absolute invulnerability cannot be guaranteed.

Personal data provided will be included in a file owned by Capitten, for the purpose of managing online product purchases and sending information about them by any means, including electronic communication.

Users have the right to access the information concerning them contained in Capitten’s file, rectify inaccuracies, cancel, or oppose processing, by email or written communication addressed to Capitten at the address indicated in the Legal Notice of this Website.
